Operationalizing NPP and Consent Workflows for Part 2 and HIPAA

The alignment of 42 CFR Part 2 with HIPAA is no longer theoretical. Enforcement began on February 16, 2026, and the HHS Office for Civil Rights (OCR) is now fully engaged in investigating complaints, reviewing breach notifications, and assessing compliance.
Many practices are waiting for their EHR vendor to roll out integrated consent tools — and those tools are coming. National efforts are underway to standardize consent frameworks and exchange mechanisms that will eventually make this easier.
But waiting for perfect technology is not a compliance strategy.
OCR expects practices to update their Notice of Privacy Practices (NPP), implement the new TPO consent, and build redisclosure workflows now, using the systems they already have. The good news: you don’t need a major system overhaul to get started. You need clear workflows, updated forms, and a consistent process for documenting patient rights and consent.
Below is a practical, operational guide to help your practice begin.
1. Start with the Updated Notice of Privacy Practices (NPP)
The model NPP language is available on the HHS website at https://www.hhs.gov/hipaa/for-professionals/privacy/guidance/model-notices-privacy-practices/index.html.
Operational workflow:
- Update your NPP using the model language
- Replace the NPP everywhere it lives: website → intake packets → patient portal → front desk signage
- Train staff on how to explain the new sections
- Begin collecting updated NPP acknowledgments from all patients going forward
This is the foundation for everything else.
2. Implement the New TPO Consent
The updated rule allows patients to sign a single consent authorizing future disclosures of treatment, payment, and operations (TPO) across the HIPAA ecosystem. This is a major simplifier for both patients and providers.
Operational workflow:
- Add the new TPO consent to your intake packet
- Use plain language scripts so staff can explain what’s changing
- Offer both paper and electronic signature options
- Document revocations and ensure they are communicated across teams
This single consent streamlines care and supports coordinated care while preserving patients’ control over non-TPO disclosures.
3. Capture, Scan, and Upload Forms into HIM
Even without an integrated EHR solution, practices can build a defensible, repeatable workflow.
Operational workflow:
- The front desk collects the updated NPP acknowledgment and TPO consent
- Forms are scanned the same day into the patient’s chart
- HIM verifies indexing and visibility for clinical, billing, and care coordination teams
- A simple audit log tracks which patients have updated forms and which still need outreach
OCR expects consistency, documentation, and traceability. Remember, enforcement is underway, so integrate these processes today.
4. Additional Low-Cost Workflow Solutions

- Create a “Part 2 Intake Checklist” that ensures every patient receives the updated NPP, signs the TPO consent, and has the forms uploaded.
- Add a Part 2 flag or label in the EHR. Even without automation, a visual cue helps staff pause before redisclosing information.
- Use standardized scripts for explaining the new consent. This reduces variability and protects staff from over- or under-explaining.
- Build a simple redisclosure decision tree: A one-page reference: TPO allowed → yes; beyond TPO → need consent; legal request → escalate.
- Update BAAs to include Part 2 obligations. OCR will expect this.
- Run a 30-day “catch-up campaign.” Outreach to existing patients to collect updated NPP acknowledgments and TPO consents.
